Welcome to Togera. Please read these Terms & Conditions ("Terms") carefully. By creating an account, publishing a listing, requesting a ride, or using any feature of the Togera platform, you agree to comply with and be bound by these Terms.

1. Important Legal Position & Role of Togera

Togera is solely an online marketplace and community platform.

• No Transportation or Travel Services: Togera is NOT a transportation company, NOT a taxi service, NOT a common carrier, and NOT a travel agency. We do not provide, operate, or manage rides, travels, or logistics.
• Independent Users: Drivers, passengers, and event organizers are independent community members. Drivers are not employees, agents, or contractors of Togera.
• Interaction at Own Risk: Users communicate and interact entirely at their own risk. Passengers are solely responsible for verifying the credentials and choosing whom they travel or associate with.
• No Guarantees: Togera does not guarantee the behavior, honesty, identity, safety, punctuality, background, vehicle condition, roadworthiness, or reliability of any user. We do not conduct criminal background checks or mechanical vehicle safety inspections.
• Disclaimer of Eventualities: Togera is not responsible or liable for any accidents, physical injuries, thefts, property damage, disputes, harassment, misconduct, cancellations, delays, or criminal acts occurring before, during, or after any ride-share trip, travel plan, activity, hangout, or meeting.
• Private Agreements: Any booking, agreement, or ride-share coordination is solely a private contract between the participating users.

2. Payment Disclaimer

Togera does not process payments or facilitate transactions between users:

• No Financial Collection: Togera does not collect, hold, or escrow money. We do not act as a payment gateway or payment processor.
• Outside Transactions: Any cost-sharing contributions or payments must be arranged and completed directly between users outside the Togera platform.
• No Refund Handling: Togera is not responsible for handling refunds, resolving payment disputes, or covering losses if one party fails to pay their agreed share. Users are fully responsible for all monetary arrangements.

3. User Accounts & Responsibilities

• Age Limitation: You must be at least 9 years old to register an account or use our platform.
• Information Accuracy: You must provide truthful, current, and complete information during registration and keep your profile details updated.
• Credential Security: You are responsible for keeping your login credentials and password secure. You must not share, license, or sell access to your account to any other person.

4. Driver Specific Obligations

Drivers who publish carpools represent and warrant that they are solely responsible for:

• Maintaining a valid, active driving license suitable for the vehicle type.
• Holding comprehensive vehicle insurance cover and third-party liability coverage.
• Ensuring the vehicle is legally registered, roadworthy, clean, and mechanically safe.
• Obeying all local traffic laws, speed limits, and safety regulations.
• Obtaining any permissions, permits, or tolls required under local jurisdictions.
• Ensuring that carpool pricing represents a reasonable split of fuel and road expenses, and is not operated for commercial profit.

5. Passenger Specific Obligations

Passengers who book or request to join a carpool or trip must:

• Arrive on time at the designated pick-up location.
• Treat the driver, other passengers, and the vehicle with respect and care.
• Obey all local laws and safety guidelines during the trip.
• Never bring illegal substances, weapons, or contraband into a host's vehicle.
• Independently verify vehicle license plates and the driver's identity before starting the ride.

6. Prohibited Activities & Community Rules

Users are strictly prohibited from engaging in the following behaviors:

• Creating fake profiles, fraud, or impersonating others.
• Harassment, discrimination, hate speech, or threats.
• Spamming, hosting scams, or illegal schemes.
• Selling illegal goods, weapons, or narcotics.
• Soliciting prostitution, escort services, or sexual services.
• Human trafficking or money laundering operations.

7. User Content License

You remain the owner of the content you publish on Togera (e.g. photos, titles, trip descriptions, feedback reviews). However, you grant Togera a non-exclusive, royalty-free, worldwide license to host, display, and distribute this content solely to operate and promote our platform.

8. Account Suspension & Termination

Togera reserves the right, in its sole discretion and without liability, to suspend, restrict, or permanently delete any user account that violates these Terms, harms our community, or compromises platform security.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TOGERA, ITS FOUNDERS, EMPLOYEES, OR INFRASTRUCTURE PARTNERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR PERSONAL HEALTH INSURANCES) ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE PLATFORM, LISTINGS PUBLISHED, COORDINATED TRAVELS, OR TRANSACTIONS AND INTERACTIONS BETWEEN USERS.

10. Indemnification

You agree to defend, indemnify, and hold harmless Togera, its founders, and service providers from and against any claims, liabilities, damages, judgments, losses, costs, or expenses (including reasonable attorney fees) arising from your actions, trips, communications, offline meetings, payment arrangements, or violations of these Terms.
